According to CLP Regulation (Regulation (EC) No 1272/2008), CMR substances are defined as follows:

minimum requirement

Substances which have been classified as carcinogenic, mutagenic or reprotoxic in the CLP Regulation 1272/2008, respectively (see table) must not exceed the following percentages (m/m) in chemicals and products:

Except titanium dioxide (CAS 13463-67-7), if the product is placed on the market as a liquid mixture or as an article, as the classification of titanium dioxid refers only to inhalable dusts (powdery).

Change of criteria

Titanium dioxide has to be labelled with H351 in powdery products from 1 October 2021 if > 1wt% particles with an aerodynamic diameter of ≤10 µm are contained. 
Therefore, the following exemption is defined:
Except titanium dioxide (CAS 13463-67-7), if the product is placed on the market as a liquid mixture, as the classification of titanium dioxid refers only to inhalable dusts (powdery).
